Media Licensing & Copyright Notice

The short version
When we create media for you, we keep the copyright and grant you a license to use it. Every service includes a Standard License, which covers marketing the specific property you hired us to shoot. If your project needs more, expanded licenses are available and summarized below, with the full text of each available in the license agreements. Pricing depends on the media and the license you need, so contact us for a quote.
Standard License
A non-exclusive license to market a specific property, residential or commercial, for its sale or lease.
- Covers the digital and print marketing of the subject property for the life of the listing, whether the property is for sale or for lease.
- After the property sells or leases, you may continue to use the media to promote your own services, such as in a portfolio of past work.
- Does not cover ongoing commercial use of the media, such as continuous rental or leasing operations, business or brand promotion other than your own services, or hospitality and lodging use (hotels, resorts, and vacation or short-term rentals).
- The media may not be used to market or represent any property other than the subject property.
- The media may not be assigned, sold, sublicensed, or redistributed as stock to any third party, except to upload and distribute it through a Multiple Listing Service or similar listing and syndication services, in connection with the sale or lease of the subject property.
- We retain ownership of the media and may use it for any purpose, including its sale or license to third parties.
Commercial License
A non-exclusive license for unlimited commercial use of the media.
- Covers unlimited use of the media in perpetuity for any commercial purpose, including ongoing commercial use such as hospitality and lodging operations (hotels, resorts, and vacation or short-term rentals) and business or brand promotion.
- Extends use beyond the subject property: media created at a model or representative property may be used to market other substantially similar units, models, or lots within the same apartment or multifamily community, development, or subdivision.
- The media may not be assigned or sold to a third party, except to upload and distribute it through a Multiple Listing Service or other platforms that present the property, or other similar properties covered by this license, to the public.
- We retain ownership of the media and may use it for any purpose, including its sale or license to third parties.
Exclusive License
An exclusive license for unlimited commercial use of the media.
- Covers unlimited use of the media in perpetuity for any commercial purpose, including ongoing commercial use such as hospitality and lodging operations (hotels, resorts, and vacation or short-term rentals) and business or brand promotion.
- Extends use beyond the subject property: media created at a model or representative property may be used to market other substantially similar units, models, or lots within the same apartment or multifamily community, development, or subdivision.
- The media may not be assigned or sold to a third party, except to upload and distribute it through a Multiple Listing Service or other platforms that present the property, or other similar properties covered by this license, to the public.
- We retain ownership of the media, but limit our use to editing and delivering the media to you. The media will not be licensed to anyone else.
Copyright Transfer
A full transfer of ownership in the media.
- All rights in the media, including copyright, transfer to the new owner.
- The new owner receives all raw and edited files.
- We retain no copies, keep no rights in the media, and make no further use of it.
